2.1 The Data Protection Officer (DPO) - Ms Lucinda Hart - is responsible for ensuring that this notice is made available to data subjects.

2.2 All members of staff of The Balloon Lady who interact with data subjects are responsible for ensuring that this notice is drawn to the data subject's attention and their consent to the processing of their data is secured.

3. Privacy Notice

3.1 Who are we? And what data do we collect and process?

The Balloon Lady provides Balloon decoration for wedding receptions, parties and corporate events. This is our main website -

The personal data we may ask for, and use to help us with your enquiry, or product order, is described in detail below. We also have 'Website Terms & Conditions' section below.

The Balloon Lady is registered in England and Wales. Our companies house registration number is to be added.

What data do we process? And how is it used?

On our website we receive data from our secure (HTTPS)contact web form or via email. To be able to answer any business enquiries we securely collect, and store, the following data:

- Name.

- Email.

- Telephone number.

- The users enquiry (a large text box).

Other data may be collected in our web forms, but this is product order specific and not personal data.

If this data is sent via our contact web form the completed web form is sent to our DPO, Ms Lucinda Hart.

This data can also be sent via email, again, directly to Ms Lucinda Hart.

This data is stored on a PC that is password protected.

3.2 Consent

By consenting to this privacy notice you are giving us permission to process your personal data specifically for the purposes identified in this document. Consent is required for The Balloon Lady to process your of personal data, but it must be explicitly given.

3.3 Disclosure

We do not pass on, or share, or sell the personal data your provide which is only ever used within the company on a 'need-to-know-basis'.

3.4 Retention Period

We store data for the duration of each indivual business enquiry. If no business order was made, then the data (from the web form or email) is deleted. If an order was made then the data is stored for this business customer on both a password protected PC and sometimes filed in paper format for accounting purposes.

3.5 Your rights as a data subject

At any point while we are in possession of or processing your personal data, you, the data subject, have the following rights:

- Right of access - you have the right to request a copy of the information that we hold about you.

- Right of rectification - you have a right to correct data that we hold about you that is inaccurate or incomplete. This can be done contacting our DPO, Ms Lucinda Hart.

- Right to be forgotten - in certain circumstances you can ask for the data we hold about you to be erased from our records. Again, this can be done contacting our DPO, Ms Lucinda Hart.

- Right to restriction of processing - where certain conditions apply to have a right to restrict the processing.

- Right to object - you have the right to object to certain types of processing. NOTE - we do not do any direct marketing or pass your data onto any third parties.

- Right to judicial review: in the event that Organisation Name refuses your request under rights of access, we will provide you with a reason as to why. You have the right to complain as outlined in clause below.

All of the above requests will be forwarded on should there be a third party involved in the processing of your personal data.

In the event that you wish to make a complaint about how your personal data is being processed by The Balloon Lady, or how your complaint has been handled, you have the right to lodge a complaint directly with the supervisory authority and The Balloon Lady data protection representatives Data Protection Officer, Ms Lucinda Hart.

NOTE - we do not use any cookies that we have implemented ourselves and only use one third-party cookie from a single third party - see below.

As mentioned several times above, we do not share or sell any personal data with any third party. We do however use some third party services that use cookies to gather non-personal data on this website. These services, and the cookies they use, are described below.

5.1 Analytics cookies for measuring our website usage.

Like many websites we use 'Clicky Web Analytics' to analyse the use of our website by using cookies. Clicky does not collect any personal identifiable information, as shown in their privacy policy.

During a visit to our website the following data is sent to thge tracking servers:

Page URL, page title, referrer, User agent, IP address, Language, screen resolution, tracking cookie.

Our analytics service provider generates statistical and other information about website use by means of cookies.

The names of the analytics cookies set by the tracking servers are - _jsuid and cluid.

_jsuid: This is a random number that is generated by the Code the first time someone visits a web site with the Code installed. Its sole purpose is to better identify new and unique visitors to a web site. The value of this cookie is sent to the Service for every event logged. The value of this cookie will also be set as a third party cookie with the name of "cluid" if such a cookie does not exist. The purpose of this is for web sites with multiple domains and who want to track visitor sessions across multiple domains, which is not possible with first party cookies. This cookie is set to more or less never expire.

The information generated relating to our website is used to create statistics and reports about the general use of our website.

7. Website Terms of Usage

If you continue to browse and use this website you are agreeing to comply with and be bound by the following terms and conditions of use.

1. Our Purchasing and Returns Policy

We believe you will be delighted with your purchase but if you are not entirely satisfied it may be returned for an exchange or refund within 14 days of receipt. Refunds will be made within 14 days of receipt of goods returned, providing they are in perfect, unopened condition .

This is with the exception of all custom made items, such as bouquets, bows, printed balloons etc, with unless they have been damaged in transit and we are notified on the day of receipt.

Cancellations must be made within 48 hours of the order being placed, after this time and once an item has been dispatched we reserve the right to charge a 10% re-stocking fee.

Return delivery charges are the responsibility of the customer and we recommend that you Return items by registered post or recorded delivery and keep a proof of posting.

If you need to return an item to us please contact us using the contact details below stating whether you require an exchange or refund and enclose it with your parcel.

We reserve the right not to accept returned goods after 14 days or if the goods are not in perfect condition. This guarantee is in addition to your statutory rights.

2. Online Shopping - T&C's:

1. All shoppers get an order notification email from our Payment Service Provider immediately after payment. This email includes the order item(s), cost, transaction and order ID numbers and full contact details for both the PSP and 'The Balloon Lady.'

2. All orders are processed within 24 hours. All orders are sent by 1st class post within 48 hours. Delivery times for the UK between vary 1 and 5 days.

3. Our Product Delivery Policy

Deliveries will be made to the address supplied by the customer. Please ensure that all information given is correct, including postcode and contact number. Your parcel will be sent out on a ‘signed for’ service and can be sent to a home or work address.

Helium cylinders require a signature on delivery and on collection. Delivery and collection must be made at the same address. A ‘mis-collection’ cost of £35.00 is incurred if the cylinder is not available for collection on the arranged date.

Orders are subject to availability of stock and where possible will be sent out within 7–10 days. Bouquets, printed balloons and custom made items may take longer.

We will advise you at the time of placing your order if a longer wait may be expected.

We reserve the right to make small substitutions if necessary – for example where products are unavailable – such as one colour ribbon being unavailable for a bouquet, we would substitute another colour matching the colour scheme.

4. Product Information and Pricing

All our latex balloons are manufactured from pure, natural latex and are fully Biodegradeable – decomposing at about the same rate as an oak leaf.

The price of goods are those specified and the price shown
is inclusive of Vat. There will be an additional charge for delivery. All orders are subject to availability and in the unlikely event that the required goods are unavailable, the customer will be notified by email. Price and availability information is subject to change without notice.

5. Safety Warning

Young children could choke or be suffocated by an uninflated balloon or piece of balloon. Adults should inflate balloons and supervise their use with children under eight (7) years of age. Keep uninflated balloons away from children. Discard broken balloons immediately.

Do not deliberately inhale Heligas – although not poisonous it can results in asphyxiation. Keep Away from children at all times – responsible adults only should use cylinders and other equipment. If transporting the cylinder by car ensure that the vehicle is well ventilated and the cylinder is
secured in place.
